Terms of Service

1. Acceptance

By purchasing the AI Performance & MLOps Platform on Microsoft Azure Marketplace, you agree to these terms in addition to the Microsoft Customer Agreement and the Microsoft Marketplace Terms.

2. Subscription and billing

Subscriptions are sold and billed exclusively through Azure Marketplace. Metered overage is reported via the Marketplace metering API at hour-bucket granularity. You authorize us to report such usage based on data collected from connectors you enable.

3. Acceptable use

• No reverse-engineering, resale, or rebranding without a written agreement.
• No use to monitor systems you don't own or aren't authorized to monitor.
• No uploading of personal data of EU/UK data subjects beyond what is needed to operate the service.

4. SLA

Standard and Enterprise plans target 99.9% monthly uptime for the API control plane. Service credits are issued as detailed in your plan's service-level agreement.

5. Termination

You may cancel at any time through the Azure portal; access ends at the end of the paid period. We may suspend the service for non-payment, abuse, or breach of these terms with notice as required by Marketplace policy.

6. Liability

Our aggregate liability is capped at fees paid in the 12 months preceding the claim. Neither party is liable for indirect or consequential damages.

7. Governing law

These terms are governed by the laws of the State of Washington, USA, excluding its conflict-of-law rules.
